1. The service and acceptance
ProfitTriage AI is an online business-profit diagnostic and decision-support service operated by the provider identified above. By creating an account, purchasing a subscription or otherwise using the service, you agree to these Terms and the Privacy Policy.
2. Eligibility and accounts
You must have legal capacity to enter into these Terms. You are responsible for providing accurate account information, protecting your credentials and activity under your account. You may not use another person's account without authorization.
3. Your inputs
You are responsible for the accuracy, legality and rights to use information you enter. ProfitTriage outputs depend on the figures supplied and on the assumptions stated in the product.
4. Modeled outputs, not guarantees
Profit, capacity, pricing, break-even, profit-potential and client-risk outputs are automated mathematical scenarios. They are not guarantees of future results, market prices, customer behavior, revenue or profit.
5. Not professional advice
ProfitTriage is not accounting, tax, legal, investment or regulated financial advice. You remain responsible for business decisions and for obtaining qualified professional advice where appropriate.
6. Free and Pro access
The Free tier provides the features shown as free in the service. ProfitTriage Pro unlocks paid features, including the Full Profit Prescription and other Pro functionality. Access to paid features is verified against the subscription status associated with the signed-in account.
7. Price, billing and renewal
The standard ProfitTriage Pro base price is $29 per month, exclusive of applicable taxes, unless a different price is clearly displayed before checkout. Pro is a recurring subscription that renews automatically each billing period until cancelled. Stripe processes payments and provides billing management. Applicable taxes may be added on top of the base price based on customer location and tax status. The Subscription & Cancellation Policy forms part of these Terms.
8. Consumer withdrawal rights
If you purchase as a consumer and mandatory consumer law applies, you may have a statutory right to withdraw from a distance contract, generally within 14 days from conclusion of the contract for an online digital service. Any lawful consequences of requesting immediate performance during that period are governed by mandatory law. ProfitTriage does not rely on a waiver or loss of a statutory withdrawal right unless the legally required express request, consent and information have been obtained. Instructions and a model notice are provided in the Subscription & Cancellation Policy.
9. Complaints and mandatory consumer rights
Nothing in these Terms limits rights that cannot lawfully be excluded, including mandatory consumer rights relating to conformity of digital services. Service or billing complaints can be submitted through the contact form. We may request information reasonably needed to identify the account or transaction.
10. Acceptable use
You may not misuse the service, attempt unauthorized access, interfere with security, overload the service, circumvent paid-access controls, reverse-engineer protected portions where prohibited, or use the service for unlawful activity.
11. Availability and changes
We may maintain, update or improve the service and may change features where reasonably necessary. We do not promise uninterrupted or error-free availability. Material changes affecting an active paid subscription will be handled in accordance with applicable law.
12. Intellectual property
ProfitTriage software, brand, interface and original content are protected by applicable intellectual-property laws. You retain rights to your own business data.
13. Liability
To the maximum extent permitted by applicable law, the provider is not liable for indirect, incidental, special or consequential losses arising from business decisions based on modeled outputs. Nothing in these Terms excludes or limits liability or statutory rights that cannot legally be excluded or limited.
14. Termination
You may stop using the Free service at any time. Paid renewal can be cancelled as described in the Subscription & Cancellation Policy. We may restrict access for material breach, fraud, abuse, security risk or legal necessity, subject to mandatory law.
15. Governing law
These Terms are governed by the laws of the Czech Republic. If you are a consumer, this choice does not deprive you of mandatory consumer protections that apply to you under applicable law.
16. Alternative dispute resolution
If a consumer dispute cannot be resolved directly, the competent entity for out-of-court consumer dispute resolution in the Czech Republic is the Czech Trade Inspection Authority (Česká obchodní inspekce), Central Inspectorate – ADR Department, Gorazdova 1969/24, 120 00 Praha 2, Czech Republic, email: adr@coi.gov.cz.
